Terms of Service

Welcome to Lofi.club, a music streaming service provided by Rightsify Group LLC ("Rightsify"). By using Lofi.club, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully as they govern your use of Lofi.club.

1. Access to Lofi.club: Lofi.club provides a music streaming service accessible via the web. You may access the service only for lawful purposes and in accordance with these Terms. Rightsify reserves the right to modify or discontinue, temporarily or permanently, any part of Lofi.club with or without notice.

2. Intellectual Property: Lofi.club and its entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Rightsify or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3. Use of Service: You may only use Lofi.club for personal, non-commercial purposes. You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content on Lofi.club without the prior written consent of Rightsify. You may not use Lofi.club in any way that violates any applicable federal, state, local, or international law or regulation, or for any purpose not expressly permitted by these Terms.

4. User Content: Lofi.club may allow users to post or upload content, including but not limited to comments, photos, and videos. By submitting such content, you grant to Rightsify a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any and all media or distribution methods now known or later developed.

5. User Conduct: You may not use Lofi.club to harass, abuse, impersonate, or intimidate any person, or to post or transmit any content that is obscene, vulgar, defamatory, or otherwise offensive or objectionable. You may not use Lofi.club for any commercial purpose or to solicit others to join or become members of any other commercial online service or other organization.

6. Disclaimer of Warranties: Lofi.club is provided "as is" and without warranty of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Rightsify does not warrant that Lofi.club will be uninterrupted or error-free, nor does it make any warranty as to the accuracy or reliability of any information obtained through Lofi.club.

7. Limitation of Liability: In no event shall Rightsify or its affiliates be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of Lofi.club or with the delay or inability to use Lofi.club, or for any information, software, products, or services obtained through Lofi.club, or otherwise arising out of the use of Lofi.club, whether based on contract, tort, strict liability, or otherwise, even if Rightsify has been advised of the possibility of damages.

8. Indemnification: You agree to indemnify, defend, and hold harmless Rightsify, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account, including negligent or wrongful conduct by you or any other person accessing Lofi.club using your account.

9. Termination: Rightsify may terminate your access to Lofi.club at any time without notice, in its sole discretion, for any reason, including, without limitation, any breach by you of these Terms.

10. Governing Law: These Terms and any dispute arising out of or related to these Terms or Lofi.club shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision or rule.

11. Dispute Resolution: Any dispute arising out of or related to these Terms or Lofi.club shall be resolved through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Wilmington, Delaware. The award of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12. Miscellaneous: These Terms constitute the entire agreement between you and Rightsify with respect to the use of Lofi.club. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Rightsify's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Rightsify in writing.

13. By using Lofi.club, you agree to these Terms and acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use Lofi.club.
